En di\u00e1logo con \u201cRadio Sky FM 106.1\u201d, el Dr. Gualampe habl\u00f3 sobre las consultas m\u00e1s frecuentes que recibe, incluyendo temas de cuota alimentaria, indemnizaciones por accidentes laborales y el r\u00e9gimen de visitas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00abHay muchos casos que se pierden por falta de informaci\u00f3n sobre los procesos judiciales\u00bb, destac\u00f3 el abogado, enfatizando la importancia de la asesor\u00eda legal. \u00abMuchas veces la justicia es lenta, pero da resultado\u00bb, reconoci\u00f3, aclarando que \u00abhay casos laborales que demoran entre dos o tres a\u00f1os, y casos de da\u00f1o y perjuicio que demoran cuatro o cinco a\u00f1os\u00bb. Gualampe explic\u00f3 que la \u00ababogac\u00eda nunca fue exacta\u00bb, y que la resoluci\u00f3n de un caso puede variar mucho en tiempo y forma, dependiendo de la complejidad del mismo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uno de los temas m\u00e1s recurrentes, seg\u00fan el Dr. Gualampe, son las indemnizaciones por accidentes laborales: \u00abHan pasado dos a\u00f1os y medio y nunca presento una demanda\u00bb, cont\u00f3 sobre un caso que le consult\u00f3 un vecino, \u00abLos dos a\u00f1os y medio nosotros ten\u00edamos desde el momento del infortunio, desde el momento del accidente, desde el hecho directamente. Bueno, desde ah\u00ed ten\u00edamos dos a\u00f1os para presentar la demanda laboral y en todo caso al haber pasado dos a\u00f1os y medio nos quedamos directamente que estar\u00eda prescrita la causa\u00bb. En este sentido, el abogado hizo hincapi\u00e9 en la importancia de actuar con rapidez para no perder el derecho a la indemnizaci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Otro punto clave en la conversaci\u00f3n fueron las dudas sobre la cuota alimentaria: \u00abLa cuota alimentaria siempre est\u00e1, digamos, la discordia en estas situaciones\u00bb, coment\u00f3 el Dr. Gualampe. \u00abDepende del pap\u00e1. Si el pap\u00e1 est\u00e1 debidamente registrado, el pap\u00e1 le pagan con un recibo de haberes, si el pap\u00e1 trabaja para la administraci\u00f3n p\u00fablica o para la administraci\u00f3n o en este caso para una empresa privada y generalmente damos, se le descuenta un 15 % por hijo\u00bb. El especialista explic\u00f3 que la cuota alimentaria se calcula en base al ingreso del padre, y que hay una tabla que fija un porcentaje m\u00ednimo para los padres que trabajan en negro.<br>\u00abLa cuota alimentaria no solamente es alimento, sino tambi\u00e9n hablamos de vestimenta, inclusive de esparcimiento, recreaci\u00f3n\u00bb, detall\u00f3 Gualampe, explicando que la cuota debe cubrir todos los gastos necesarios para el desarrollo del menor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Dr. Gualampe tambi\u00e9n abord\u00f3 el tema del r\u00e9gimen de visitas: \u00abLa cuota alimentaria va por un lado y lo que es el r\u00e9gimen comunicacional o el r\u00e9gimen de visitas va por el otro. Son independientes los dos\u00bb. Hizo \u00e9nfasis en la importancia de que el padre pueda tener una relaci\u00f3n con sus hijos, incluso cuando la pareja se separa. \u00abNo hay que llegar tampoco a esta instancia. Hay que buscar siempre que haya una relaci\u00f3n directamente de los hijos con el pap\u00e1\u00bb, recomend\u00f3 el abogado, haciendo referencia a un caso reciente en el que una madre fue condenada por impedir que el padre vea a sus hijos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Dr. Gualampe dej\u00f3 un mensaje claro: \u00abSiempre primero los ni\u00f1os y tambi\u00e9n su derecho\u00bb.
