Afirm\u00f3 que impedir el accionar del Estado configura un delito penal.<\/p>\n\n\n\n<p>En una entrevista con el programa radial \u00abPreso en mi Ciudad\u00bb de Sky FM 106.1 MHZ, el fiscal Diego Funes ofreci\u00f3 detalles clave sobre el conflicto por la posesi\u00f3n de tierras en Finca El Pongo, luego de que la familia Ib\u00e1\u00f1ez denunciara presuntos atropellos judiciales y policiales durante el reciente desalojo.<\/p>\n\n\n\n<p>Funes explic\u00f3 que el conflicto se origin\u00f3 en el fuero civil: \u201cEsto tiene su origen en un juicio civil que inicia el Estado Provincial en contra del se\u00f1or Ib\u00e1\u00f1ez, y en fecha 7 de julio se comunica una resoluci\u00f3n de desalojo dictada por la justicia civil\u201d. Al d\u00eda siguiente, seg\u00fan detall\u00f3, se hizo efectivo el desalojo en un amplio predio, pero \u201cno hab\u00eda personas en el lugar al momento del procedimiento, por lo tanto, la jueza de paz entrega la posesi\u00f3n al Estado Provincial\u201d.<\/p>\n\n\n\n<p>Aclar\u00f3 tambi\u00e9n que la orden judicial exclu\u00eda las viviendas familiares: \u201cLa orden de desalojo incluye todo el predio, a excepci\u00f3n de dos viviendas, los corrales de animales y un reservorio de agua. La casa no fue objeto de desalojo\u201d, enfatiz\u00f3.<\/p>\n\n\n\n<p>Sobre los hechos posteriores al desalojo, el fiscal relat\u00f3 que \u201cel Estado comenz\u00f3 a realizar actos posesorios, como instalar maquinaria y cercar el terreno, y que en ese momento surgieron interrupciones: \u201cPersonas se paraban frente a las m\u00e1quinas, hac\u00edan fogatas y romp\u00edan los cercos\u201d.<\/p>\n\n\n\n<p>A ra\u00edz de estas acciones, \u201cse imput\u00f3 a varias personas por el delito de turbaci\u00f3n de la posesi\u00f3n, conforme al art\u00edculo 181 del C\u00f3digo Penal\u201d, confirm\u00f3 Funes. Respecto a la situaci\u00f3n de un menor incluido entre los involucrados, aclar\u00f3: \u201cNo se puede promover acci\u00f3n penal contra una persona menor de edad. Se activ\u00f3 la causa y se trat\u00f3 conforme al protocolo correspondiente\u201d.<\/p>\n\n\n\n<p>Ante denuncias de supuestos excesos policiales, el fiscal fue tajante: \u201cNo advierto que haya un proceder irregular de la polic\u00eda. Actuaron acompa\u00f1ando a la jueza de paz y luego intervinieron ante la comisi\u00f3n de delitos, como corresponde\u201d.<\/p>\n\n\n\n<p>Tambi\u00e9n rechaz\u00f3 la politizaci\u00f3n del caso: \u201cNo me corresponde analizar intencionalidades pol\u00edticas. Mi tarea es investigar hechos, no especulaciones\u201d.<\/p>\n\n\n\n<p>Finalmente, Funes subray\u00f3 que el derecho sobre las tierras fue resuelto por la justicia civil y que las v\u00edas de hecho no son el camino adecuado:<\/p>\n\n\n\n<p>\u201cNo se puede parar enfrente de una m\u00e1quina e impedir que avance, porque la justicia civil le dio la raz\u00f3n al Estado Provincial. Si uno considera injusta una resoluci\u00f3n, debe acudir a la justicia, no a la v\u00eda de hecho.
