La iniciativa busca prevenir el cr\u00e9dito irresponsable, frenar los embargos y d\u00e9bitos autom\u00e1ticos sobre sueldos y jubilaciones que afectan la subsistencia, y ofrecer un mecanismo judicial y administrativo para reestructurar deudas de manera justa sin comprometer la canasta b\u00e1sica.<\/p>\n\n\n\n
Ante el alarmante nivel de morosidad y sobreendeudamiento que asfixia a millones de familias argentinas, la diputada nacional Mar\u00eda In\u00e9s Zigar\u00e1n (UCR \u2013 Provincias Unidas) impuls\u00f3 un proyecto de ley integral para la creaci\u00f3n del \u00abR\u00e9gimen de Prevenci\u00f3n y Tratamiento del Sobreendeudamiento de Personas Humanas\u00bb. La iniciativa busca frenar los abusos financieros, proteger el m\u00ednimo vital de los hogares e incorporar en la legislaci\u00f3n argentina la figura de la \u00absegunda oportunidad\u00bb para deudores de buena fe.<\/p>\n\n\n\n
El proyecto aborda un problema estructural de flujo de ingresos: familias con empleo o jubilaci\u00f3n que, acorraladas por altas tasas de inter\u00e9s y refinanciaciones sucesivas, no logran cubrir necesidades b\u00e1sicas como alimentaci\u00f3n, vivienda, salud y servicios.<\/p>\n\n\n\n
\u00abEl sobreendeudamiento de los hogares dej\u00f3 de ser un caso aislado para convertirse en una crisis que golpea la dignidad de las familias\u201d, declar\u00f3 la diputada juje\u00f1a. Y afirm\u00f3 que la idea no es plantear un salvataje bancario ni el uso de fondos p\u00fablicos para pagar deudas privadas, sino \u201cproponer una regla clara y justa: prevenir la concesi\u00f3n irresponsable de cr\u00e9dito, proteger el plato de comida en la mesa de los argentinos y dar un mecanismo ordenado para pagar lo posible y salir de la condena de la deuda perpetua\u00bb.<\/p>\n\n\n\n
Puntos clave del proyecto de ley<\/p>\n\n\n\n
\n
Protecci\u00f3n Inviolable del M\u00ednimo Vital: se establece que los procesos de cobro o reestructuraci\u00f3n no podr\u00e1n afectar los recursos necesarios para cubrir alimentos, vivienda, salud, educaci\u00f3n y servicios. El piso objetivo de protecci\u00f3n estar\u00e1 fijado por el valor de la Canasta B\u00e1sica Total (CBT) del INDEC seg\u00fan el hogar y la regi\u00f3n.<\/li>\n\n\n\n
Freno a los Embargos y Descuentos Autom\u00e1ticos: al iniciar el procedimiento, el juez podr\u00e1 congelar ejecuciones y suspender c\u00f3digos de descuento y d\u00e9bitos autom\u00e1ticos sobre sueldos y jubilaciones que atenten contra la subsistencia del deudor, garantizando adem\u00e1s la continuidad de los servicios p\u00fablicos esenciales.<\/li>\n\n\n\n
Sanci\u00f3n al Cr\u00e9dito Irresponsable y Acoso Financiero: se obliga a los bancos y proveedores no financieros (fintech, tarjetas, comercios) a evaluar fehacientemente la capacidad de pago antes de otorgar un cr\u00e9dito. Ante pr\u00e1cticas irresponsables o cobranzas abusivas y hostiles, la justicia podr\u00e1 quitar intereses moratorios, punitorios y reducir tasas.<\/li>\n\n\n\n
Conciliaci\u00f3n Gratuita y Unificada: se habilita una instancia administrativa y gratuita ante las autoridades de Defensa del Consumidor para negociar un plan unificado de pago con todos los acreedores a la vez, con un plazo m\u00e1ximo de hasta 36 o 60 meses.<\/li>\n\n\n\n
\u00abSegunda Oportunidad\u00bb y Liberaci\u00f3n de Saldos (Zero Income \/ Salvataje): para aquellas personas de buena fe que, tras una rigurosa investigaci\u00f3n patrimonial, demuestren una incapacidad absoluta de pago y ausencia de bienes realizables, la ley prev\u00e9 la liberaci\u00f3n inmediata de los saldos impagos, permiti\u00e9ndoles reinsertarse en la econom\u00eda formal.<\/li>\n<\/ol>\n\n\n\n
Un enfoque federal responsable<\/p>\n\n\n\n
El proyecto respeta las autonom\u00edas provinciales, delegando la tramitaci\u00f3n en la justicia y autoridades locales de consumo, y no representa ning\u00fan gasto fiscal ni creaci\u00f3n de nuevos organismos o fondos estatales. Asimismo, protege la transparencia crediticia al exigir el reporte exacto y actualizado de datos, evitando condonaciones autom\u00e1ticas o retroactivas.<\/p>\n\n\n\n
\u00abCon este proyecto buscamos pasar del cobro salvaje y fragmentado a un esquema civilizado: primero prevenir, luego negociar globalmente y, finalmente, permitir que las familias argentinas puedan recuperar su tranquilidad y sus proyectos futuros\u00bb, concluy\u00f3 Zigar\u00e1n.<\/p>\n\n\n\n
